1. Acceptance of Terms
These Terms of Service ("Terms") are a legally binding agreement between you and StoryBound Tech LLC ("StoryBound," "GameBound," "we," "us," or "our") governing your access to and use of the GameBound website and the table-side games we provide (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
2. Description of Services
GameBound is a digital playground for the restaurant table — quick, quiet games designed for two players sharing one phone. We offer GameBound as a white-label experience that restaurants can brand as their own. We may modify, suspend, or discontinue any part of the Services at any time without notice or liability.
3. Eligibility
The Services are intended for use by restaurant operators and their guests. If you use the Services on behalf of a business, you represent that you are authorized to bind that business to these Terms. Children may play GameBound games under the supervision of a parent, guardian, or other responsible adult.
4. Restaurant and White-Label Use
We provide tools that let a restaurant present GameBound under its own brand. Each restaurant is responsible for its own branding, content, and any representations it makes to its guests. A restaurant's branded experience is operated by that restaurant; StoryBound provides the underlying game technology.
5. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law;
- Interfere with, disrupt, or place an undue burden on the Services or their infrastructure;
- Attempt to gain unauthorized access to any part of the Services or related systems;
- Reverse engineer, decompile, or disassemble any part of the Services, except as permitted by law;
- Copy, scrape, or redistribute the Services or their content without our written permission; or
- Remove or alter any proprietary notices contained in the Services.
6. Intellectual Property
The Services, including all software, game designs, text, graphics, and logos (other than a restaurant's own brand assets), are owned by or licensed to StoryBound and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Services for their intended purpose. All rights not expressly granted are reserved.
7. Third-Party Links and Services
The Services may reference or link to third-party websites or services that we do not control. We are not responsible for the content, policies, or practices of any third party, and your use of them is at your own risk.
8. Disclaimers
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.
9. Limitation of Liability
To the maximum extent permitted by law, StoryBound and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Services. Our total liability for any claim relating to the Services will not exceed one hundred U.S. dollars ($100).
10. Indemnification
You agree to defend, indemnify, and hold harmless StoryBound and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Services or your violation of these Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law principles. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Maryland.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after an update means you accept the revised Terms.
